This Agreement constitutes the full set of terms and conditions governing your participation, purchases, bids, sales, and all other interactions on our website. Site Usage & Restrictions

Our website lets you shop online. However, there are things you can’t do:

-You can’t do anything that might harm our rating system.

Payment Procedures and Invoice Processing

Pink Noise Professionals Pvt. Ltd decides how payments should be made. Usually, you need to pay before we accept your order. You can pay with a credit card, debit card, through net banking, or by bank deposit. We’ll send you an invoice with your order unless you tell us otherwise. We might cancel or refuse orders at our discretion. If there are any mistakes in our pricing or offers, we can cancel orders. If you’re late with your payment, we might charge a late fee of 1% per month on the overdue amount. This fee will continue every 30 days until you pay.

Refund Policy

We don’t have to give you a refund if you’ve simply changed your mind about a purchase, so please think carefully before buying. If the goods are faulty, we’ll follow the law and meet our obligations. If you’ve paid for an order but then cancel it before we ship it, we’ll deduct 5% of the amount for transaction fees and refund the remaining 95%.

Risk of Loss

When you buy something from our website, it’s under a shipment contract. In India, we use courier services for all shipments, and they include insurance to protect against loss or damage during transit (calculated at 1% of the invoice value). If your order is declared ‘lost,’ you’ll get a full refund.

Pricing & Product Descriptions

The List Price you see on our website reflects the full retail price suggested by the manufacturer or supplier, or estimated based on industry standards. It’s an estimate and might not always match prices elsewhere or on any given day. For items sold as sets, the List Price could be the sum of each item’s individual retail price. If a merchant is selling an item, they might provide the List Price. If we accidentally list an item at a lower price than it should be, we may either ask you what to do before shipping or cancel your order and let you know.

We can’t guarantee that product descriptions or other content on our site is always accurate, complete, reliable, current, or error-free. If a product you receive isn’t as described, your only option is to return it unused.

Recognition of Rights

Warranty Disclaimer and Liability Limitations

We are not liable for indirect, special, or consequential damages, or any loss of revenue, profits, or data, related to this Agreement or the Program, even if we’ve been advised of the possibility of such damages. Additionally, our total liability under this Agreement and the Program will not exceed USD 2,000 or the total price of the products paid or payable to you, whichever is less.

We do not provide any express or implied warranties or representations regarding the Program or any products sold on our website, including fitness for a particular purpose, merchantability, non-infringement, or any implied warranties arising from a course of performance, dealing, or trade usage. We also don’t guarantee that our site will operate without interruption or errors, and we are not liable for any consequences of interruptions or errors. This site, along with its information, content, materials, products, and services, is provided on an “as is” and “as available” basis. You understand and agree that your use of this site is at your own risk.

Confidentiality

You agree to keep confidential any information you receive from us, our clients, advertisers, and suppliers. Any information provided by an end-user customer as part of a Program is the property of Pink Noise Professionals Pvt. Ltd. This customer information is confidential and must not be disclosed. Non-Waiver

Pink Noise Professionals Pvt. Ltd’s failure to enforce any terms, conditions, or covenants in this agreement does not mean we give up our rights or remedies, nor does it waive any future breaches. The terms, conditions, and covenants of this agreement remain valid and enforceable.

Neither party’s waiver of a breach of any provision in this agreement applies to subsequent or prior breaches of the same or any other provision.

Miscellaneous

This Agreement is governed by and interpreted in accordance with the laws of India, without considering conflict-of-laws principles.

Any dispute, controversy, or difference arising between the parties regarding this Agreement is exclusively subject to the jurisdiction of the courts of India. Other courts are excluded, without regard to conflict of laws principles or your actual state or country of residence.

This agreement contains the entire understanding between the parties regarding its subject matter and supersedes any other agreements concerning it. Your rights under this agreement cannot be assigned or transferred to anyone else, and any attempt to do so may lead to termination of the agreement without liability to us. However, we reserve the right to assign this agreement to any party at any time without notice.

If any provision of these Terms and Conditions is found invalid or unenforceable according to a judicial decree or decision, it will apply only to the maximum extent permitted by law, and the rest of these Terms and Conditions will remain valid and enforceable as stated.
